1. Acceptance of Terms

By accessing and using FriendlyMasseurs ("the Service", "Platform", "Website"), you ("User", "You", "Your") accept and agree to be bound by these Terms of Service ("Terms", "Agreement"). This is a legally binding agreement between you and FriendlyMasseurs. If you do not agree to these terms in their entirety, you must immediately cease using our service.

Your continued use of the Platform constitutes ongoing acceptance of these Terms and any future modifications we make to them.

2. Service Description

FriendlyMasseurs is an online directory platform connecting individuals with LGBTQ+ friendly massage therapists and wellness practitioners. We provide a listing service only and facilitate discovery and connection between users and providers.

IMPORTANT: FriendlyMasseurs is NOT a service provider. We are a directory platform. We do not employ, endorse, recommend, or assume responsibility for the services, actions, conduct, or qualifications of any practitioner listed on our platform. All services are arranged and provided independently between users and practitioners.

3. User Account and Eligibility

Age Requirement:

You must be at least 18 years of age to create an account or use this Service. By creating an account, you represent and warrant that you are 18 years of age or older. We reserve the right to request proof of age at any time.

Account Creation and Security:

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

Login and Password Reset:

You will log in using your registered email address and password. If you forget your password, you can request a password reset link to be sent to your registered email address. You are responsible for maintaining access to your registered email account.

User Conduct:

All users agree to:

• Use the service respectfully, lawfully, and in accordance with all applicable laws and regulations
• Not harass, abuse, threaten, discriminate against, or intimidate practitioners or other users
• Not engage in any fraudulent, deceptive, or misleading conduct
• Not violate any person's legal rights, including privacy and intellectual property rights
• Not post or transmit any unlawful, harmful, threatening, abusive, defamatory, or obscene content
• Not attempt to gain unauthorized access to the Platform or other users' accounts

4. Provider Listings and Subscriptions

Provider Accounts and Dashboard:

Providers who create a listing will receive access to a personal dashboard where they can:

• Upload and manage professional photos
• View and respond to reviews
• Manage their subscription and billing
• Update their profile information and contact details
• Monitor their listing status and verification progress

Professional Photo Requirements - NO NUDE PHOTOS:

STRICTLY PROHIBITED: All photos uploaded to FriendlyMasseurs MUST be professional and appropriate for a wellness directory. Nude photographs, sexually explicit images, or any content of a sexual nature are STRICTLY PROHIBITED and will result in immediate account suspension and removal from the platform without refund. This includes but is not limited to: nudity, exposed genitalia, sexually suggestive poses, or any content that violates our professional standards.

Acceptable photos include: professional headshots, workspace/studio photos, fully-clothed professional photos demonstrating massage techniques, and certification documents. All photos are subject to review and approval by our moderation team.

Subscription Plans and Billing:

Provider listings require an active paid subscription. Subscription fees are charged according to the plan you select (Basic, Premium, or Professional). You can manage your subscription, update payment methods, and view billing history through your dashboard's billing section.

NO REFUND POLICY:

IMPORTANT - READ CAREFULLY: All subscription fees are NON-REFUNDABLE. Once payment is processed, we do not offer refunds, credits, or prorated refunds for any reason, including but not limited to: early cancellation, non-use of services, dissatisfaction, account suspension for Terms violations, or verification denial. By subscribing, you acknowledge and agree to this no-refund policy.

Cancellation Policy:

You may cancel your subscription at any time through your dashboard billing section. Cancellation will take effect at the end of your current billing period. You will retain access to your listing and dashboard features until the end of the paid period. No refunds will be issued for the remaining time in your billing cycle.

Verification and Independence:

All practitioners listed on FriendlyMasseurs are independent professionals. FriendlyMasseurs conducts identity and age verification (18+) but does not verify professional licenses, credentials, qualifications, or the quality of services provided. Verification does not constitute an endorsement or guarantee of quality, safety, or competence.

Users should independently verify credentials, licenses, and reviews before booking services. PrideTouch makes no representations or warranties regarding any provider's qualifications, certifications, or the services they provide.

5. Content Guidelines and Prohibited Conduct

Professional Content Standards:

All content posted on FriendlyMasseurs must be professional, respectful, truthful, and appropriate for a professional wellness directory platform.

Strictly Prohibited Content:

• Nude or sexually explicit photographs - This is a professional wellness directory
• Content depicting or promoting illegal activities, including prostitution or sexual services
• Explicit sexual content, pornography, or sexually suggestive material
• Harassment, threats, hate speech, or discriminatory content
• False, misleading, or fraudulent information
• Spam, phishing attempts, or malicious software
• Violations of intellectual property rights
• Personal information of others without their consent

Consequences of Violations:

Violation of content guidelines will result in immediate action, including but not limited to: content removal, account suspension, permanent ban from the platform, and forfeiture of all subscription fees (no refunds). We reserve the right to report illegal activity to appropriate law enforcement agencies.

FriendlyMasseurs reserves the right to remove any content, suspend or terminate any account, at our sole discretion, without notice or refund, if we determine content violates these Terms.

6. Identity Verification and Document Handling

Verification Process and ID Documents:

All providers are required to submit government-issued identification and a verification selfie as part of our age verification process (18+ requirement). By submitting these documents, you authorize FriendlyMasseurs to collect, process, and verify your identity information.

Secure Storage and Limited Access:

Submitted identification documents are encrypted and stored securely. Access to these documents is strictly limited to FriendlyMasseurs' authorized verification staff only. Your documents are never shared with third parties, disclosed to other users, or used for any purpose other than age and identity verification.

AUTOMATIC DOCUMENT DELETION UPON APPROVAL: Once your identity is verified and your profile is approved, your government ID and verification selfie are automatically and permanently deleted from our servers within 24-48 hours. We do not retain these sensitive documents after verification is complete. This policy minimizes your privacy risk and reduces our liability as a platform.

If your profile is rejected during verification, your documents will be retained for 30 days to allow for appeals or resubmission. After 30 days, rejected documents will be permanently deleted.

User Responsibility:

You are responsible for ensuring that all submitted documents are accurate and genuine. Submitting false, fraudulent, or forged identification documents is illegal and will result in immediate account termination, permanent ban from the platform, forfeiture of all fees, and potential referral to law enforcement.

Data Breach and Security:

While we implement industry-standard security measures to protect your documents, no system is 100% secure. By submitting identification documents, you acknowledge and accept the inherent risks of online document submission. FriendlyMasseurs is not liable for unauthorized access, data breaches, or security incidents beyond our reasonable control. If a security incident occurs, we will notify affected users as required by law.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Law Enforcement Cooperation and Legal Compliance

COOPERATION WITH LAW ENFORCEMENT: FriendlyMasseurs will fully cooperate with law enforcement agencies, courts, and government authorities. We will comply with all valid legal requests, including subpoenas, court orders, search warrants, and other lawful requests for information.

We may disclose user information, content, communications, and account activity to law enforcement or government authorities when:

• Required by law, subpoena, court order, or legal process
• Necessary to investigate, prevent, or take action regarding illegal activities
• Necessary to protect the rights, property, or safety of FriendlyMasseurs, our users, or the public
• We believe in good faith that disclosure is legally required or appropriate

Users acknowledge and agree that FriendlyMasseurs may preserve and disclose account information and content if required to do so by law or if we believe such preservation or disclosure is reasonably necessary to comply with legal process, enforce these Terms, or protect the rights and safety of others.

Legal Compliance:

You agree to use FriendlyMasseurs in compliance with all applicable local, state, national, and international laws and regulations. Any illegal use of the Platform is strictly prohibited and may result in immediate termination and referral to law enforcement authorities.

9. Disclaimer of Warranties and Limitation of Liability

Service Provided "AS IS":

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Liability for Provider Services:

FRIENDLYMASSEURS IS NOT LIABLE FOR ANY DISPUTES, INJURIES, DAMAGES, LOSSES, OR ISSUES ARISING FROM SERVICES PROVIDED BY PRACTITIONERS LISTED ON OUR PLATFORM. All services are arranged, negotiated, and provided directly between users and independent practitioners. FriendlyMasseurs is not a party to these transactions.

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIENDLYMASSEURS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of any provider or user
• Unauthorized access to or alteration of your transmissions or content
• Services received from or interactions with any provider
• Any other matter relating to the Service

IN NO EVENT SHALL FRIENDLYMASSEURS'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO FRIENDLYMASSEURS IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

User Assumes All Risk:

You acknowledge and agree that you assume all risk when using the Service and when interacting with any provider. You are solely responsible for verifying credentials, licenses, and suitability of any provider before engaging their services.

10. Reporting, Moderation, and Account Termination

Community Safety:

We take community safety, security, and compliance seriously. If you experience or witness harassment, discrimination, inappropriate behavior, policy violations, or illegal activity, you must report it to us immediately through our support channels.

Content Moderation:

All provider profiles, photos, and content are subject to review and moderation by our team. We reserve the right to reject, remove, or require modification of any content at our sole discretion without notice or refund.

Right to Suspend or Terminate Accounts:

FriendlyMasseurs reserves the right, in our sole discretion, to suspend or permanently terminate any user or provider account, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Violation of content guidelines (including posting nude photos)
• Fraudulent or deceptive conduct
• Illegal activity or suspected illegal activity
• Harassment or abuse of other users
• Non-payment or payment disputes
• Failure to verify identity or age
• Any conduct we deem inappropriate or harmful to the platform or community

NO REFUNDS UPON TERMINATION: If your account is suspended or terminated for violation of these Terms, you will NOT be entitled to any refund of subscription fees, and all fees paid are forfeited.

11. Indemnification

You agree to indemnify, defend, and hold harmless FriendlyMasseurs, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party rights
• Your content or conduct on the Platform
• Services provided by or received from any provider you connect with through the Platform

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law. You waive any right to a jury trial.

13. Changes to Terms

We reserve the right to modify, update, or change these Terms at any time at our sole discretion. We will notify users of material changes via email or prominent notice on the Platform.

Your continued use of FriendlyMasseurs after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your account.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FriendlyMasseurs regarding the use of the Service and supersede all prior agreements and understandings.
